GENERAL INFORMATION

  1. These Terms and Conditions set out the conditions for the sale of goods by means of distance communication via the online shop located at http://mol-romgum.com.pl (hereinafter referred to as: the Shop), as well as the provision of other electronic services by the Seller to the Customer.
  2. The electronic services are provided by MOL ROMGUM is M.O.L. ROMGUM Ławicki i Spółka, Sp.J. based in Suchy Las at ul. Klonowa 13, 62-002 Suchy Las, NIP: 7780021256, REGON: 631533340, KRS: 0000283733 (hereinafter: "Service Provider").
  3. Through the Shop, sales are carried out by the company:
    a) MOL ROMGUM is M.O.L. ROMGUM Ławicki i Spółka, Sp.J. with its registered office in Suchy Las, at ul. Klonowa 13, 62-002 Suchy Las, NIP: 7780021256, REGON: 631533340, KRS 0000283733.

  5. These regulations are made available by the Service Provider free of charge on the shop's website at the following address http://oferta.mol-romgum.com.pl in a way that makes it possible to obtain, reproduce and record its content.
  6. These Terms and Conditions and their provisions apply only to customers who are not consumers within the meaning of Article 22 of the1 Civil Code. MOL ROMGUM sells exclusively to customers in the Shop.

DEFINITIONS

  1. Customer - entrepreneur within the meaning of the Act on Freedom of Economic Activity (Journal of Laws 2004, No. 173, item 1807, as amended), conducting business activity, making purchases for purposes related to business activity, not being a consumer within the meaning of Article 221 Civil Code.
  2. Seller - MOL ROMGUM.
  3. Shop - online shop operated at http://mol-romgum.com.pl.
  4. Regulations - these rules of procedure.
  5. Account - individual user account available after registration in the Shop
  6. Merchandise - a movable item which can be purchased by the Customer through the Store's website.
  7. Order - Customer's offer to purchase the Goods specified in the Order form.
  8. Civil Code - Act of 23 April 1964 - Civil Code (Journal of Laws 1964 no. 16 item 93 as amended),
  9. Working Days - days from Monday to Friday, with the exception of public holidays and Saturdays.

SCOPE AND CONDITIONS OF ELECTRONIC SERVICES

  1. The Service Provider allows the following electronic services to be provided through the Store."
    a) the conclusion of contracts for the sale of Goods between the Customer and the Seller,
    (b) the maintenance of the Account.
  2. The provision of electronic services takes place according to the rules set out in the Terms and Conditions.
  3. Electronic services are provided by the Service Provider free of charge.
  4. In order to use the electronic services provided by the Service Provider, it is necessary to read and accept the Terms and Conditions.
  5. Upon acceptance of the Terms and Conditions, a contract for the provision of electronic services is concluded between the Service Provider and the Client under the terms and conditions specified in the Terms and Conditions (hereinafter: "Contract for electronic services"). The Agreement for the provision of electronic services is concluded for an indefinite period of time.
  6. The Client, has the right to terminate the Agreement for the provision of electronic services at any time by submitting to the Service Provider a statement of termination of this Agreement. The Contract for the provision of electronic services is terminated upon receipt of the Service Provider's notice of termination.  
  7. To use the Shop, the following technical requirements are necessary:
    (a) a computer with Internet access,
    b) a web browser with Cookies and Javascript enabled,
    (c) access to e-mail;
  8. The customer is obliged to use the Shop in accordance with applicable law.
  9. The customer is obliged not to provide content of an unlawful nature.

REGISTRATION 

  1. To place an Order, you must have an Account with the Store.
  2. The creation of an Account requires registration, consisting of filling in a form located on the Shop's website, under the log in/register tab.
  3. The registration form must be completed correctly and in accordance with the facts. Failure to provide all required data makes it impossible to create an Account.
  4. The Seller may make the use of the Shop dependent on the authentication of the data provided by him/her by sending relevant documents. The provision of false data, refusal to submit the documents required by the Seller or their negative verification are grounds for blocking the Account.
  5. Only a natural person duly authorised to do so may register a Customer who is a legal person or an organisational unit that is not a legal person and make all declarations of will and knowledge in electronic form in the Account in its name and on its behalf.
  6. The Customer is not allowed to use other people's Accounts or to make his/her Account (login and password) available to unauthorised persons. In order to secure access to the Account, the Customer shall establish an access password upon registration. The service provider is not responsible for any actions carried out by unauthorised persons and falling within the scope of Account management.
  7. The Client must inform the Service Provider of any change of e-mail address. In the absence of information about the change made, all notices and statements sent to the address provided during registration will be deemed to have been effectively delivered.
  8. The Customer is only entitled to make Orders for business purposes.

PLACING ORDERS

  1. For the avoidance of doubt, the Seller indicates that the descriptions of the Goods and any other information do not constitute an offer within the meaning of Article 66 of the Civil Code, but are only an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  2. Orders can be placed 24 hours a day, 7 days a week, except during breaks to update the Shop's data.
  3. The seller is not responsible for failures of internet and telephone connections.
  4. The application of Article 68 shall be excluded2 Civil Code.
  5. The Customer selects the Goods from the Shop's assortment, places the Goods in the basket using the "to basket" button. After moving to the basket view ("basket" field), the Customer has the possibility to verify the contents of the basket, make a choice of delivery method and payment method. After the Customer has made his/her selection, the total amount of the order is calculated. By clicking on the "order" button the Customer proceeds to the next stage, where he/she has the possibility to modify the Customer's data and delivery data.
  6. The Customer confirms the Order by clicking on the "confirm order" button, whereupon the Customer receives a confirmation of the Order both in the form of a message displayed on the website as the last step of the order placement process, as well as to the e-mail address indicated in the registration form.
  7. Placing an Order constitutes an offer made to the Seller to purchase the Goods at the prices specified in the Order. By placing the Order, the Customer undertakes to collect the Goods and to pay the price of the Goods and delivery costs.
  8. If the Seller accepts the Order, it confirms its acceptance for execution. Acceptance of the Order for execution constitutes acceptance of an offer within the meaning of the Civil Code. The contract shall be deemed concluded upon the Seller's confirmation of acceptance of the Order for execution.
  9. The costs of providing an incorrect delivery address or failing to collect the parcel at the address provided shall be borne solely by the customer.
  10. The seller has the right to withdraw from the sales contract, within 7 days of the following grounds:
    a) failure by the Customer to make a prepayment within 3 days of the Order,
    b) the Customer's failure to make payment and to collect the Goods in person at the Seller's premises within 3 days of the Order.
  11. If, after conclusion of the sales contract, it turns out that it cannot be performed for reasons for which the Seller is not responsible, e.g. end of production of the Goods, change of the model of the Goods, the Seller shall inform the Customer of the situation, and the concluded sales contract shall expire.
  12. The Shop Owner issues a sales document - a VAT invoice. VAT invoices are issued and sent to the Customer in paper form. Sending the invoice electronically is possible upon mutual agreement.
  13. All prices of the Goods in the shop are given in PLN, gross.

PAYMENTS

  1. The seller accepts the following forms of payment: 
    a) prepayment to the Seller's bank account (made on the basis of a PROFORMA invoice),
    (b) payment in cash on collection in person,
    (c) payment by cash on delivery,
    (d) payment using przelewy24 payments.
  2. The transfer details will be sent to the Customer on his/her e-mail indicated in the Customer Account.
  3. The deadline for prepayment is 3 days.

DELIVERY OF GOODS

  1. Delivery of goods is only possible to the address indicated in the Customer Account. 
  2. The delivery date is:
    a) when the goods are in stock at the Seller's premises at the time of acceptance of the Order: up to 5 Business Days from the date of crediting the bank account in the case of prepayment,
  3. In other cases, the seller will inform you of the waiting time by telephone or e-mail.
  4. In the event of an extension of the delivery time, the seller will immediately inform the ordering party during a telephone call or by e-mail. 
  5. The Seller shall not be liable for any loss incurred by the Buyer as a result of a delay in the delivery of the Order.
  6. The Goods are dispatched to the Customer once the payment for the purchased Goods has been credited to the Seller's account.
  7. Deliveries are made via DHL courier service.
  8. Delivery costs are:
    a) PLN 35.00 gross - shipment weight up to 7 kg,
    b) PLN 40.00 gross - shipment weight up to 20 kg,
    c) PLN 50.00 gross - shipment weight up to 40 kg,
    d) PLN 80.00 gross - shipment weight up to 60 kg,
    e) 120 PLN gross - shipment weight over 60 kg.
  9. If the value of the order is equal to or greater than PLN 10,000 gross, the shipping cost is covered by the Seller.
  10. Delivery costs for non-standard, oversized and bespoke goods are agreed individually.
  11. Once the consignment has been dispatched, the customer will receive, by e-mail, a confirmation of dispatch with the consignment note number and a link to the carrier's tracking page.
  12. The benefits and damages of the Goods and the danger of loss or damage shall pass to the Customer at the moment the Goods are handed over by the Seller to the courier company.
  13. The customer to whom the goods have been sent by courier service is obliged to check the consignment in the manner established for consignments of a given type. If the Customer discovers irregularities or damage that occurred during transport, he is obliged to immediately carry out the appropriate actions necessary to establish the carrier's liability.

WITHDRAWAL FROM THE CONTRACT

  1. Pursuant to the Consumer Rights Act of 30 May 2014, the customer has the right to withdraw from the online sales contract without stating a reason within 14 days of receiving the delivery. To meet this deadline, it is sufficient to send a declaration of withdrawal to the email address romgum@mol-romgum.com.pl.
  2. In accordance with the Consumer Rights Act of 30 May 2014, the direct costs of returning the goods for cancellation within 14 days of receipt of the Goods shall be borne by the Customer (Article 34(2)).

GUARANTEE

  1. Goods sold by the Seller may be covered by a manufacturer's warranty.
  2. In the case of Goods covered by a guarantee, information on the existence and content of the guarantee is presented in each case in the Shop or supplied with the Goods.
  3. The terms of the guarantee shall be determined by the manufacturer of the Goods. 

INFRINGEMENTS 

The Seller reserves the right to block and delete an Account in the case of a gross violation of the Terms and Conditions or the law.

SELLER'S AND SERVICE PROVIDER'S LIABILITY

  1. The Seller disclaims any warranty for physical or legal defects in the Goods.
  2. The Seller and the Service Provider will endeavour to ensure that the Shop operates in a continuous manner. However, the Seller and the Service Provider reserve the right to make interruptions in the operation of the Shop in order to update data, archive data, repair errors or perform other maintenance work. Neither the Seller nor the Service Provider is obliged to inform the Clients about the planned interruption in the functioning of the Shop.
  3. The Vendor and the Service Provider are not liable for damages resulting from:
    a) it is not possible to place an Order for reasons beyond the Seller's or Service Provider's control,
    b) misuse of the Shop by the Customer,
    c) failure of the customer's Internet, hardware or software.
  4. The Client may submit a complaint to the Service Provider in connection with the use of services provided electronically. The complaint may be submitted in electronic form and sent to maria@mol-romgum.com.pl. The Client should include a description of the problem in the complaint notification. The Service Provider shall promptly, but not later than within 14 days, consider the complaint and respond to the Client.

AMENDMENT TO THE RULES OF PROCEDURE

  1. The Service Provider reserves the right to amend the Terms and Conditions.
  2. Amendments to the Terms and Conditions shall take effect as soon as they are explicitly indicated and posted on the Store's website, with the proviso that Orders placed prior to the effective date of such amendments shall be fulfilled as before.
  3. In the case of Customers who are registered in the Shop, they will be informed of the changes and the possibility of accepting them when they log in for the first time in the Shop from the time these changes take effect.
  4. If the Client does not agree to the change, he/she has the right to terminate the Agreement for the provision of electronic services within 14 (fourteen) days from the date of the first login after the change of the Terms and Conditions by submitting a notice of termination to the Service Provider. 

PERSONAL DATA

  1. The provision of personal data by the Customer is voluntary, but necessary to set up an Account.
  2. The administrator of the personal data is the Service Provider. The data of Customers who have given their consent are made available to the Seller for the purpose of order processing.
  3. Any personal data obtained during the operation of the Shop is processed in accordance with the Personal Data Protection Act of 29 August 1997 (Journal of Laws 2016, No. 922 as amended). 
  4. The customer has the right to request additions, updates, corrections. personal data, temporarily or permanently suspend their processing or delete them if they are incomplete, outdated, untrue or have been collected in violation of the provisions of the Personal Data Protection Act of 29 August 1997 (i.e. Journal of Laws of 2016, No. 922 as amended) or are no longer necessary for the purpose for which they were collected.
  5. The personal data of customers who have given their consent will be processed in order to provide them with electronic commercial information concerning the Shop's offer. 

FINAL PROVISIONS

  1. In matters not covered by the above Regulations, the provisions of the Civil Code shall apply.
  2. Any disputes arising between the Seller and the Customer shall be submitted to the court having jurisdiction over the registered office of the Seller.
